Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Ubvelela ("Company," "we," "us," or "our") concerning your access to and use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

Services

Ubvelela provides branding, signage, vehicle wrapping, printing, and corporate gifting services. All services are subject to availability and may be modified, suspended, or discontinued at any time without notice.

User Responsibilities

By using our services, you agree to:

Provide accurate and complete information when requesting services
Use our services only for lawful purposes
Not infringe on the intellectual property rights of others
Not use our services in any way that could damage, disable, or impair our website
Comply with all applicable laws and regulations

Quotes and Pricing

All quotes provided are estimates and are valid for 30 days unless otherwise specified. Final pricing may vary based on project specifications, materials, and scope changes. We reserve the right to adjust pricing if project requirements change after the initial quote.

Payment Terms

Payment terms will be specified in individual project agreements. Generally:

A deposit may be required before work commences
Payment is due upon completion or as agreed in writing
Late payments may incur interest charges
We reserve the right to withhold delivery until full payment is received

Intellectual Property

All designs, concepts, and materials created by Ubvelela remain our intellectual property until full payment is received. Upon full payment:

You receive a license to use the final approved designs for their intended purpose
We retain the right to display completed work in our portfolio
You retain ownership of any materials, content, or trademarks you provide

Revisions and Approvals

Clients are responsible for reviewing and approving all designs, proofs, and materials before production. Once approved, we are not responsible for errors that were present in the approved materials. Additional revisions beyond the agreed scope may incur extra charges.

Cancellations and Refunds

Cancellation policies vary by project type:

Design phase: Full refund of unused deposit minus work completed
Production phase: No refund for custom materials or work in progress
Completed projects: No refunds unless there is a defect in workmanship

Warranties and Limitations

We warrant that our work will be free from defects in materials and workmanship for a period specified in your project agreement. This warranty does not cover damage from misuse, accidents, or normal wear and tear. Our liability is limited to repair or replacement of defective work.

Limitation of Liability

To the maximum extent permitted by law, Ubvelela shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service in question.

Indemnification

You agree to indemnify and hold Ubvelela harmless from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of South Africa.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
